1.2 QUANTITY.
SELLER will sell and BUYER will buy goods as set forth in Exhibit 1.2 (“GOODS”) in the quantity as set forth in Exhibit 1.2.
Any quantity set forth in Exhibit 1.2 is an estimate and not a minimum purchase obligation.
BUYER is entitled to purchase GOODS from other suppliers for qualification purposes even if BUYER commits to purchase its requirements for the GOODS in whole or in part from SELLER.
BUYER, its parents, affiliates, subsidiaries or designated third parties, will order GOODS from SELLER by purchase orders or other means of ordering and the terms of this AGREEMENT are incorporated by reference.
BUYER is entitled to revise the SPECIFICATIONS, and unless SELLER objects, such revised SPECIFICATIONS will replace the prior SPECIFICATIONS.
Upon BUYER’s request, SELLER will provide a supply assurance plan to BUYER.
