The decision to prolong the investigation up to one year is issued by the prosecutor supervising the investigation or by the prosecutor directly superior (prokurator bezpośrednio przełożony) to the prosecutor conducting the investigation and above one year—by the prosecutor of a higher level (prokurator nadrzędny) to the prosecutor conducting the investigation or supervising it. 117 § 130 Regulation 2016.

Prokuratorem nadrzędnym jest prokurator kierujący jednostką organizacyjną prokuratury wyższego stopnia, a także prokurator tej jednostki lub prokurator delegowany do niej w zakresie zleconych mu czynności.
§ 2.
W sprawach czynności prowadzonych przez prokuratora w Prokuraturze Krajowej lub w Głównej Komisji prokuratorem nadrzędnym jest Prokurator Generalny.

prokurator przełożony vs nadrzędny
Regulamin stanowi, że nadzór służbowy nad czynnościami prokuratorów podległych sprawują prokurator przełożony i zwierzchnik służbowy (§ 42). Wniosek z tego, że w prokuraturze zwierzchnictwo służbowe pokrywa się ze zwierzchnictwem procesowym. Nadzór służbowy sprawuje nad prokuratorami podwładnymi ich prokurator przełożony bezpośrednio, czyli kierownik danej jednostki organizacyjnej, a także przełożony nadrzędny, czyli prokurator wyższego stopnia. § 47 Regulaminu jako funkcje nadzorcze w ramach nadzoru służbowego wymienia nadzór instancyjny oraz wizytacje i lustracje. Formą nadzoru służbowego w obrębie prokuratury jest instytucja aprobaty, której wymagają postanowienia kończące postępowanie przygotowawcze, akty oskarżenia oraz środki odwoławcze sporządzone przez asesora (§ 51 Regulaminu).
