As the Control Reports reflect, the BUYER did not invest in or purchase any additional “bulldozer, excavator, loader, separating plant, mobile compressor, electric crane for the processing plant, piezometers for measuring water levels, a charging hopper, conveyor belts, transporter, a grizzly screen and a vibration sieve for the loading plant” beyond the specific materials required (and enumerated in the Control Reports) to satisfy its investment obligation.
